Has India's angel tax been abolished?
Yes — the Union Budget 2024 abolished Section 56(2)(viib) (the 'angel tax') for all classes of investors, effective April 2024. Previously this provision taxed any premium above fair market value as 'income from other sources,' creating major friction for early-stage rounds. The repeal is one of the biggest pro-startup tax changes in Indian history.
What's the difference between iSAFE and a US SAFE?
iSAFE (Indian Simple Agreement for Future Equity, popularized by 100X.VC) is structured to be RBI-compliant and avoids the convertible-note restrictions that apply in India. It converts to CCPS at the next priced round. Unlike a US SAFE, the iSAFE explicitly addresses Indian foreign exchange and pricing rules.
Do Indian angels invest in companies incorporated outside India?
Some do, but the majority prefer Indian-incorporated companies (or Singapore/Delaware structures with Indian operating subsidiaries) for tax-treaty and regulatory reasons.
